A MARRIED HIV positive businessman from Bulilima District has appeared in court facing charges of raping his 20-year-old female employee.

Godrick Mabhena, 39, who runs a grocery shop at Madlambuzi Business Centre, allegedly broke into the woman's bedroom in the middle of the night while she was sleeping and had sex with her once without her consent.

After committing the offence, Mabhena allegedly knelt on the ground and apologised to his victim in a bid to stop her from reporting the matter.

Mabhena allegedly took advantage of his wife's absence who had travelled to her rural home for a couple of days to attack the woman.

He and the woman, who works for him as a shop keeper, lives in the same cottage using different rooms.

Mabhena appeared before Plumtree magistrate Gideon Ruvetsa on initial remand and was remanded in custody to December 4.

The court heard that on October 18, the woman was preparing supper at her home when Mabhena approached her and offered to assist her since his wife was not around.

She agreed and went on to prepare the food with her employer's assistance and they ate their supper together. While they were eating, Mabhena allegedly proposed love to the woman and indicated that he wanted to have sex with her but she turned him down.

He tried to persuade the woman by professing his undying love for her and even indicated that he was prepared to leave his wife in order to start a fruitful relationship with her, the court heard.

Prosecuting, Elisha Mazorodze said Mabhena went back to his room after being rejected but returned to the woman's room around 2AM.

"Mabhena gained entry into the complainant's bedroom through an unlocked door and told her that he had come to have sex with her. He grabbed the complainant and pinned her to the floor. The complainant screamed for help but no one came to her rescue," said Mazorodze.
