DEAR SIR OR MADAM,

RE: IN THE MATTER / CASE BETWEEN    THE STATE OF ZIMBABWE

                        (MTHWAKAZI TRIO)

We as the Mthwakazi Liberation Front Youth Network hereby petition the Zimbabwean state to the above mentioned case of the Mthwakazi trio. First and foremost MLF Youth Network is and must be understood as the people's army but not the army that is bent on overthrowing the government or have that capacity to overthrow. We as the youth Network are more of keeping the spirit of our Mthwakazi people up by making them to believe in themselves.

We also keep their hopes of the long lost freedom alive, we inspire our people to risk a lot more in pursuit of their long overdue quest for a free independent and democratic Mthwakazi State. The rule that we have experienced as Mthwakazi Youth from our birth is chillingly brutal and economically ineffective. Brutality is a symptom of failure for the Mthwakazian. Mthwakazi Youth Network is a disciplined force that teaches and practice tolerance as is the requirement in a diverse and democratic society.

We would like to put it on record that the ideology for the new Mthwakazi State is independent and free from imperialism and is organized on a national scale founded upon the conception of a one and united nation drawing its strength from the modern science and technology and traditional national beliefs that the free development of each tribe is conditioned by the development of all.

The restoration of the Mthwakazi State is all not about tribalism or hatred or the suppression of the other or superiority of another.

We are against and condemn any form of tribalism, racism, regionalism and colonialism.  We would like to make it clear that we as Mthwakazi liberation Front Youth Network are not tribalist and we will never be. We believe it is the right time to divorce ourselves from this evil marriage that we put ourselves in, in the 1980s era. It is all to us about accepting who we are, identifying ourselves and living side by side with equally shared responsibilities.
 
We have as the Mthwakazi Youth identified three crises which we need to address to our people urgently which are;
1.    Moral crisis
2.    Spiritual crisis
3.    Identity crisis

As the Youth Network, challenge the right of these courts set to hear the cases on of the Mthwakazi Trio on the following grounds:
•    Our leaders (Mthwakazi Trio) will not be afforded a fair and proper trial
•    We consider ourselves as Mthwakazians who are neither morally nor legally
obliged to obey any rules made by the parliament of Zimbabwe where we are not represented.

•    In a political trial such as the present one which involves the clash of the aspiration of the Mthwakazi People and those of Zimbabweans, the country's courts as presently constituted cannot be impartial and fair. It is highly suspicious that a Judiciary that is entirely controlled by the regime and enforces laws enacted by the Zimbabwean parliament is not party to. It is true that Mthwakazians who are charged in a court of law enjoy on the surface the same rights and privileges as the Zimbabweans in so far as the conduct of this trial is concerned, but it will be grossly inaccurate to conclude from this fact that Mthwakazians consequently enjoys equality before the Zimbabwean law. In its meaning equality before the law means the right to participate in the making of the laws in which one is governed.

•    The strict bail conditions of the Mthwakazi Trio and their recently revoked bail, and the proposed exportation of their trial to Harare Zimbabwe is a clear testimony of a dictatorship, interference, disrespect of the accused rights and the blatant disregard of the presumption of the "Innocent till proved otherwise".

In light of the above circumstances, we as the Mthwakazi Liberation Front Youth Network hereby petition the Zimbabwe government as our colonizer and neighbor to;
i.    Drop all charges against the Mthwakazi Trio with immediate effect.

ii.    Start and initiate negotiations and invite MLF and other Mthwakazi organizations and representatives to a negotiated political settlement.

iii.    Stop its bullying tactics and use of state security agents and resources to harass, abuse and intimidate our leaders and Mthwakazi citizens as evidenced their unnotified incarceration and revoking of their bail conditions. As the Youth Network we have noted with concern the escalating brutality and violence in our Mthwakazi areas perpetuated by the state agents and security forces. This is based on provoking unruliness and confrontation between our citizens and Zimbabweans for this regime to get a justified assault on our people. We urge the Zimbabwean government to stop and allow political activities and debates to happen amongst our citizens freely.

iv.    We demand that MLF must be given room to operate as a registered and recognized political organization and stop arbitrary arrest of our leaders by the Zimbabwean government. 
             
Lastly we urge our respected neighbor and its government to seek assistance and advice from the outside world, international organizations and neighboring states on how to handle this sensitive case of our independence because they are in anyway interested and affected parties. As Mthwakazi Youth Network we are going to stop at nothing, using and exhausting all the avenues available for us to achieve our solitary goal of independence which we seek to restore at the will of our people.

We give our colonizer and respected neighbor the Zimbabwean government up to the 29th of February 2012 to respond to our demands.
