Zapu to lose property over debt

THE High Court has issued a writ of execution against movable property belonging to the Zimbabwe People's Union (Zapu) for its failure to settle their rentals of more than $9 000.

The writ follows an order by senior Bulawayo High Court judge, Justice Nicholas Ndou that Zapu pays $9 350 together with interest at the prescribed rate of five percent on the sum of $550 calculated from 1 June last year.

The political party was also ordered to pay holding over damages in the sum of $36,67 per day calculated from 1 March this year to the date of eviction together with interest from the date each daily amount becomes due to the date of full payment.

The court ordered that Zapu, the defendant and all claiming through it, to vacate Number 18 corner Jason Moyo Street and Connaught Avenue, failure which the Deputy Sheriff be authorised to eject them from the property.

Justice Ndou further ordered Zapu to pay the plaintiff or its legal practitioner the sum or sums due to them with costs.

The plaintiff, Mr Edson Chemhere Mabudapasi entered into a lease agreement with Zapu in March last year.

The lease agreement took effect from 1 April the same year and was for six months up to 30 September last year at rentals of $1 100 per month. It was renewable.

Zapu made a part payment of its rent for the month of June last year and remained with a shortfall of $550.

From July last year, Zapu did not pay anything and by 29 February this year the rentals had accumulated to $9 350.

From March this year, after the lease agreement had been cancelled, Zapu has been incurring holding over damages in the sum of $36, 67 per day.

Mr Mabudapasi through his lawyer, Mr Ndabezinhle Mazibuko, of Calderwood, Bryce Hendrie and Partners then issued summons against Zapu and 20 July this year, the High Court issued a writ of ejectment.
